Bébé & Me Collective (“the Business,” “we,” “our,” or “us”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website or enroll in The Way Back to You, our 1:1 coaching program (“the Program”).

By using our website and/or enrolling in the Program, you agree to the collection and use of your information in accordance with this policy. If you do not agree with the terms of this Privacy Policy, please do not access the website or enroll in the Program.

 

2. Definitions

· Website — the website located at [insert your domain name], operated by us, including any pages hosted on our Kajabi account.

· Services — the Website and the Program, along with any other related offerings, support, or communications.

· Program — The Way Back to You, our 1:1 coaching offer, including your intake assessment, personalized 30-day plan, coaching calls, and Telegram support, as described to you at the time of booking.

· Personal Data — any information about a living individual who can be identified from that data.

· Sensitive Information — a category of Personal Data that includes health information, mental or physical wellbeing information, and similar special categories of data, which receives heightened protection under this policy (see Section 9).

· Usage Data — data collected automatically, such as IP address, browser type, and time spent on pages.

· Controller — refers to us, as we determine how your personal data is processed.

· Processor (or Service Provider) — third-party platforms we use to process your data, including Kajabi (website hosting, checkout, and payment processing), Telegram (messaging and voice-note support), and a third-party video conferencing platform used for coaching calls.

· User (or Data Subject) — you, the person accessing our Services and submitting Personal Data.

 

3. Is This Policy a Contract?

This Privacy Policy is a required notice, not a contract. However, by using our website or enrolling in the Program, you acknowledge and accept the practices outlined herein.

 

4. Information We Collect

Personal Data. We may collect your name, email address, payment information (securely processed by Kajabi and its payment processor), and information you provide in your intake assessment, coaching calls, or Telegram messages and voice notes — including Sensitive Information you choose to share about your physical or mental wellbeing.

Usage Data. Browser type, IP address, operating system, and time spent on the Website.

We collect this information when you enroll in the Program, when you communicate with us via email, Telegram, or intake forms, when you attend a coaching call, and through Website interaction or marketing engagement.

 

5. Cookies and Tracking

Our website may use cookies, including those set by Kajabi, to improve performance and track usage. You can manage cookie preferences via your browser. Disabling cookies may affect how some parts of our site function.

 

6. How We Use Your Information

We use your data to:

· Provide and manage the Program, including your intake assessment, coaching calls, and Telegram support

· Respond to your questions or intake form

· Process payments

· Send Program-related communications, including scheduling and onboarding information

· Send marketing communications, where you have given consent (see Section 7)

· Improve our Services

· Comply with legal obligations

We will never use your data for any purpose beyond the scope of the Service without your explicit consent.

 

7. Marketing Communications and Your Consent

We will only send you marketing or promotional emails if you have given express consent — for example, by enrolling in the Program or signing up for our list — or where you have an existing relationship with us and the message directly relates to that relationship. Every marketing message includes a working unsubscribe link, and you may withdraw your consent at any time. We will action unsubscribe requests within five working days, in accordance with the Spam Act 2003 (Cth). Program-related communications necessary to deliver the Program you enrolled in — such as scheduling, onboarding, and support messages — are not marketing and are not subject to unsubscribe.

 

8. How We Share Your Information

We will never sell or rent your data. We may share it:

· With trusted third-party service providers, including Kajabi, Telegram, and our video conferencing platform, solely to deliver the Program and operate the Website

· If legally required, such as in response to a subpoena or court order

· To protect our rights or safety, or that of our users

 

9. Sensitive Information — Additional Protections

Information you share about your physical or mental health, wellbeing, or postpartum experience during your intake assessment, coaching calls, or Telegram support is treated as Sensitive Information and receives heightened protection. We will not use this information in testimonials, case studies, marketing, or any public-facing material without your separate, explicit, written consent. Access to this information is limited to the Business's founder and is not shared with third parties except as set out in Section 8.

 

10. Retention of Data

We retain your personal data only for as long as necessary for the purpose it was collected, as follows:

· Payment and financial records are retained for the period required by Australian tax law (currently 5 years)

· Intake assessments, coaching notes, and Program-related Sensitive Information are retained for up to 12 months after the end of your Program Period, then securely deleted, unless a longer period is required by law

· Telegram messages and voice notes are retained only for as long as necessary to deliver Program support and are deleted on a rolling basis once no longer needed

· Marketing contact details are retained until you unsubscribe or withdraw consent

 

11. Storage and Security

We take appropriate technical and organisational measures to protect your personal data. However, no system is entirely secure, and you share your information at your own risk. Contact us immediately at hello@bebeandmecollective.com if you believe your data has been compromised.

 

12. Data Breach Notification

If we become aware of a data breach that is likely to result in serious harm to you, we will notify the Office of the Australian Information Commissioner (OAIC) and affected individuals as soon as practicable, in accordance with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988 (Cth). Notification will include the nature of the breach, the information involved, and the steps you can take to protect yourself.

 

13. International Data Transfer

By using our Services, you agree to your data being processed and stored outside of your country, including in Australia and in the countries where our Service Providers — such as Kajabi and Telegram — operate or host data, which may include the United States and other jurisdictions. These countries may not have the same data protection laws as your home country, but we only work with providers who meet recognised industry security standards.

 

14. Your Rights

Depending on your location, you may have the following rights:

· Australia — under the Australian Privacy Principles (Privacy Act 1988), you may request access to, correction of, or deletion of your personal information, and may complain about how we handle it (see Section 16)

· European Union / United Kingdom — under the GDPR / UK GDPR, you have the right to access, rectify, erase, restrict, or port your data, and to object to certain processing

· California — under the CCPA, you have the right to know what personal information we hold, to request deletion, and to opt out of the sale of personal information (we do not sell your data)

If you are not satisfied with our response, Australian residents may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at  OAIC . Residents of other jurisdictions may contact their local data protection authority.

Our website may link to third-party platforms, such as payment gateways or resources. We are not responsible for the privacy practices of these sites. Please review their policies separately.
